Request for Comments

The Kansas Department of Health and Environment (KDHE) is providing notice of its intent to implement the proposed final remedy for Solid Waste Management Unit (SWMU) 5, the Sludge Drying Beds, at Exline, Inc. (EPA ID KSD007127327). Exline, located at 3256 E. Country Club Road, Salina, Kansas, operated as a chrome plating shop which led to chromium contamination in the groundwater and soils. SWMU 5 was used for the de-watering of sludge that was generated as part of Exline operations until 2004. The proposed remedy includes soil excavation that was completed as an interim remedial action in 2012.

The sludge drying beds were identified as SWMU 5 during the 1989 RCRA Facility Assessment. During closure activities, hexavalent chromium concentrations in the southeast corner of the SWMU exceeded the cleanup standard. Exline completed the interim remedial action of soil excavation in 2012.

In accordance with Permit Condition V.L. of the 2015 Hazardous Waste Management Facility Permit issued by KDHE, the public shall be given an opportunity to review the fact sheet prepared by KDHE to describe the proposed remedy, and administrative record prior to KDHE taking a final action. Interested parties will be given 45 days to for the evaluation of these documents used to select the proposed remedy and to provide their input into the decision-making process. All data submitted by Exline and documents that support the proposed remedy are part of the administrative record. The administrative record and the fact sheet are available for public review. Copies of the administrative record can be reviewed from August 23 through October 6, 2021, Monday through Friday, during normal business hours at the following locations:

During the public comment period any interested person may request a public hearing in writing which states the nature of the issues proposed to be raised in a public hearing. In the event that a hearing is scheduled, advance notice of the date will be given to the public. The Secretary of KDHE will make the decision regarding the implementation of the proposed remedy after the close of the public comment period. The Secretary will consider all comments received during the comment period and the public hearing, if held.

KDHE will prepare a responsiveness summary to address any comments received during the comment period, explain rationales for any revisions of corrective measures based on comments, and, if applicable, describe any modifications to the corrective measures.
